外國AI換臉黑科技deepfakes在中國火了。起因嘛，自然是這兩天上了熱搜的視頻#將朱茵的黃蓉換成楊冪的臉#，引得網友又驚又怕，紛紛喊話有關部門能補充完善相關法律法規，阻止更多的換臉視頻擴散。

最近有人將94版《射鵰英雄傳》里朱茵扮演的黃蓉換上了楊冪的臉，在網上迅速引發熱議。截至發稿前，話題#將朱茵的黃蓉換成楊冪的臉#在微博上已經達到了1.3億閱讀量了。

The video was made and posted on Sina Weibo by a man surnamed Xiao, whose online name is "Huanliange," which means "brother of face-changing" in English.

視頻由肖某，網名「換臉哥」製作並上傳網路。

The videowas slammed by netizens, who accused Xiao of disrespecting both actresses and ofviolating Yang"s image rights.

這段以假亂真的視頻走紅的同時也被網友們diss肖某不尊重兩位演員並侵犯了楊冪的肖像權。

Xiao apologized on Wednesday on Sina Weibo, saying "My initial intentionwas to help more people hear about this technology and protect celebrities fromvideos of forged, negative content."He said that he had no intention of profiting from the video. He later deleted the clips.

網友的口誅筆伐之下，肖道歉了，稱「小夥伴們，我對這次網路上的風波感到非常遺憾。創作初衷是希望讓更多朋友認識這項技術 , 避免將來有人偽造明星負面內容的視頻時 , 會給公眾人物帶來更大的損失。同時也讓更多人了解造假視頻背後的工作原理，提高公眾辨識能力。[微笑]」

Many have expressed concern thatthis deepfake technology could be used maliciously. There have been previous cases where the images of Hollywood A-listers, such asWonder Womanactor Gal Gadot andHarry Potterstar Emma Watson were spliced into pornographic content.

網友們對這個黑科技表示瑟瑟發抖，害怕換臉技術被別有用心的人濫用。畢竟，之前就有很多好萊塢明星被變臉傳到成人視頻網站，其中就包括「黑寡婦」斯嘉麗和《哈利波特》中赫敏的扮演者艾瑪·沃特森，等等。

"It"s too horrible! Ifface-swapvideos are used in crimes, how to recognize it"s fake?" wrote a netizen called "seaosky."

「好恐怖啊！萬一換臉技術被用在犯罪欺詐中，怎麼辨別啊？」一網友評論道。

"There"d be chaos as famous faces suddenly appear in an unlikely sex tape, which wouldviolate their reputation," wrote "Qingyuanwupeng," whose sentiments represented the views of many other Chinese commentators.

當然，網友更擔心偷摸摸看毛片時，「突然發現愛豆的臉出現在小黃片里可咋辦！想想就覺得天下要大亂，這可侵犯了明星的名譽權吧！」另一個網友喊出了大家的心聲。

This deepfake technology is not new and has become easier for the public to access, Zhu Wei, a communication and legal analyst, told the Global Times on Thursday. "The technology itself is neutral and should not be banned as it depends on how people use it," Zhu said.

所以，這個deepfakes到底如何？傳播與法律專家朱巍告訴小編，實際上，Deepfakes技術並不新鮮了，操作難度也不斷平民化。朱還說：「技術本身是中立的，關鍵在於使用這個技術的人。」「我們不應該阻止技術發展。」

However, Li Yi, a senior research fellow at the Internet Research Center affiliated to the Shanghai Academy of Social Sciences, urged thatthe law should be updated.

不過，上海社科院附屬互聯網研究中心高級研究員李易認為有關部門應儘快完善、補充有針對性的法律法規。

"As deepfake technology becomes well known in China, there will be more doctored videos. In that case,the authorities should think about how to protect the rights of those whose image has been swapped and how to ban illegal internet behavior," Li said.

「隨著deepfakes換臉技術被越來越多的中國人知道，以後會有更多這樣的換臉視頻出現。這樣一來，如何維護被換臉人的權益，如何打擊利用此項技術的不法牟利者，就需要有關部門思考商討了，」李說。

"No need to panic," said Zhu, noting thatall actions on the internet can be trackedto tell if a video is fake or not.

「沒必要害怕（這項技術），」朱巍提醒大家，所有互聯網上的痕迹都可以被追溯。也就是說，有換臉黑科技，自然就會有反向識別換臉視頻的黑科技。

針對網友們對換臉視頻是否侵犯明星肖像權和名譽權的質疑，小編請教了中國社科院法學專家支振鋒老師。

支老師說，如果擅自將換臉視頻用於商業牟利，確實對被換臉者造成了肖像權甚至名譽權的侵犯。但是如果換臉視頻涉黃涉暴，是否構成傳播淫穢物品罪還值得商榷。
